Terms and Conditions

1. General Provisions

This document sets out the terms and conditions governing the use of the TenderHub.md website (hereinafter referred to as the “Platform”), operated by TenderHub.md (hereinafter referred to as the “Operator”).

Accessing and/or using the Platform constitutes full, unconditional, and irrevocable acceptance of these Terms and Conditions. If you do not agree with them, you are required to immediately cease using the Platform.

2. Definitions

For the purposes of this document, the following terms shall have the meanings set out below:

  • “Platform” – the TenderHub.md website and all its functionalities;
  • “User” – any natural or legal person who accesses or uses the Platform;
  • “Services” – all services provided through the Platform;
  • “Content” – any data, information, text, images, or materials published on the Platform.

3. Scope of Services

The Operator provides Users with an online platform intended for:

  • Publishing and promoting tender notices, grants, and job opportunities;
  • Providing consulting services in the field of tenders;
  • Assisting Users in the preparation of tender documentation.

    • The Operator reserves the right to modify, suspend, or discontinue, in whole or in part, the Services at any time, without liability for compensation.

4. User Rights and Obligations

The User undertakes:

  • to provide accurate, complete, and up-to-date information;
  • to use the Platform in compliance with applicable laws;
  • not to infringe the rights and legitimate interests of the Operator or other Users.

The following are expressly prohibited:

  • use of the Platform for illegal or fraudulent purposes;
  • uploading or distributing unlawful, defamatory, obscene, or harmful content;
  • unauthorized access to the Platform’s IT systems;
  • use of automated programs that may affect the Platform’s functionality.

The User shall be fully liable for any damages caused as a result of violating these provisions.

5. Intellectual Property Rights

All intellectual property rights in and to the Platform and the Content belong to the Operator or its partners.

Reproduction, distribution, modification, or use of the Content in any form without the Operator’s prior written consent is prohibited, except as permitted by law.

6. Personal Data Protection

The processing of personal data is carried out in accordance with the applicable legislation of the Republic of Moldova, including Law No. 133/2011.

By using the Platform, the User consents to the processing of their personal data under the conditions set out in the Privacy Policy.

7. Disclaimer and Limitation of Liability

The Operator does not guarantee:

  • uninterrupted and error-free operation of the Platform;
  • the accuracy, completeness, or timeliness of the information;
  • the achievement of specific results through the use of the Services.

The Operator shall not be liable for:

  • any direct or indirect damages;
  • loss of profits, data, or opportunities;
  • errors or omissions in the Content;
  • temporary unavailability of the Platform.

Use of the Platform is entirely at the User’s own risk.

8. Paid Services. Payments

Certain Services may be provided for a fee. The User agrees to pay all applicable fees in full.

Payments are processed through secure systems. Fees paid are non-refundable, unless expressly provided otherwise by the Operator or required by law.

9. Suspension and Termination of Access

The Operator reserves the right to suspend or terminate the User’s access to the Platform, without prior notice, in the event of a breach of these Terms and Conditions.

10. Third-Party Links

The Platform may contain links to third-party websites. The Operator has no control over such websites and assumes no responsibility for their content, policies, or practices.

11. Governing Law and Jurisdiction

This document is governed by the laws of the Republic of Moldova.

Any disputes shall be resolved by the competent courts of the Republic of Moldova.

12. Amendments to the Terms and Conditions

The Operator reserves the right to modify this document at any time. The updated version will be published on the Platform.

Continued use of the Platform after such changes constitutes acceptance of the revised terms.
